Tycko & Zavareei LLP Reaches Favorable Settlement for Lockheed Martin Corporation in Superfund Litigation

The Ohio EPA, a private party Potentially Responsible Party, and the PRP Group sued Lockheed Martin for contribution to the efforts to clean up a waste site in Painesville, Ohio. Lockheed Martin’s predecessor, The Glenn L. Martin Company, constructed and operated a plant on a very small portion of the site from 1947-1949. From the beginning of the controversy, Lockheed Martin, through Tycko & Zavareei partner Hassan Zavareei, sought to settle the litigation and to pay its fair share of the cleanup costs. Due to the posture of the case, however, immediate settlement proved impossible. Although the litigation lasted several years, Mr. Zavareei successfully resolved the controversy efficiently and economically for his client. Ultimately, Lockheed Martin will contribute to the clean up of the site in amounts that fairly represent its operations on the site.
