Our attorneys have substantial experience litigating cutting-edge intellectual property cases in state and federal courts. Proper handling of intellectual property controversies requires substantive knowledge of the relevant body of law, together with strong litigation experience and skill.   • Trademark. Trademark litigation is very fact-intensive, requiring proof of numerous discrete elements required by state and federal law. And in most cases, gray areas of the law require creative thinking and excellent brief-writing on complex legal issues. Often, the presentation of expert testimony and reports, such as survey evidence and economic analysis, is critical to trademark litigation. Our experience with, and understanding of, these legal complexities, together with our outstanding litigation skills, enable us to prepare our client’s cases effectively from the beginning, and to carry them through to advantageous resolution.

  • Copyright. Our attorneys have litigated copyright infringement cases on behalf of corporations and associations, including submitting an amicus brief on behalf of three technology companies in the United States Supreme Court on Internet file sharing in the recent MGM, et al. v. Grokster, et al. case. We have also counseled clients on copyright matters, and written and presented on important copyright issues, such as the intersection of technology, copyright and the First Amendment.

  • Representative Cases. Our attorneys recently briefed and argued an appeal to the Fifth Circuit Court of Appeals on a novel issue of law in a dispute over the competing trademark rights of two test preparation companies operating in the same markets, using the same trade name. We also recently filed an amicus curiae brief on behalf of several software companies in the Grokster case. We are currently engaged in several copyright and trademark lawsuits across the country.
