On November 7, 2014, Tycko & Zavareei LLP filed a class action lawsuit against one of the country’s largest so-called super premium pet food companies, Blue Buffalo Company, alleging that it utilizes deceptive and misleading labeling and marketing to sell its pet food products. Specifically, the complaint alleges that Blue Buffalo falsely advertises—on its product labels as well as in print and television advertisements—that certain of its pet food products do not contain poultry by-product meal or grains. In fact, testing has revealed that many of Blue Buffalo’s products do contain these ingredients. The complaint further alleges that Blue Buffalo uses these claims—made, in part, in the company’s “True Blue Promise”—to deceive and induce consumers into paying a price premium for pet food products that they claim have superior nutritional value.
