Tycko & Zavareei LLP represents California consumers in litigation against olive oil importers and supermarkets for their false and deceptive marketing and sales practices. According to allegations in the three separate complaints, the labels on Defendants’ products mislead consumers by stating that the olive oil bottles are “IMPORTED FROM ITALY,” despite the fact that the olives from which they are made are neither grown nor pressed in Italy, and that they are of the “extra virgin” grade, despite the fact that they are not. These misrepresentations violate the California Consumer Legal Remedies Act.
The Defendants in the three lawsuits are Safeway, Inc., Salov North America Corp. and ItalFoods, Inc., as well as Med Foods, Inc. and Deoleo USA. The oils at issue include those manufactured by Bertolli, Carapelli, Filippo Berio, and Safeway. On August 27, 2014, the Superior Court of California entered an order in favor of the Plaintiff, which allowed her claims against Safeway to proceed. The Court also denied Safeway’s Motion to Strike Portions of Plaintiff’s Complaint.
