Rodan & Fields Class Action Gets Preliminary Approval

Dann v. The Rodan & Fields Company, et al., Case No. CGC-24-612800
Settlement website: https://www.brandconsultantsettlement.com/

Court grants preliminary approval over settlement of claims of wage violations and labor law non-compliance by Rodan & Fields as to its Consultants.

The class action focuses on Rodan & Fields LLC’s alleged misclassification of its Consultants as independent contractors, and failure to meet California labor law standards with respect to its Consultants. Key allegations include:

  • Failure to pay minimum and overtime wages .
  • Failure to provide mandatory meal periods or meal premium wages.
  • Failure to provide rest periods or rest break premium wages.
  • Failure to keep accurate payroll records as required by law.
  • Failure to issue timely and accurate wage statements.
  • Failure to pay wages upon employee termination.
  • Failure to reimburse workers for legitimate business expenses.
  • Engaging in unfair competition practices.

1. Unpaid Minimum Wages
The lawsuit alleges that Rodan & Fields LLC misclassified its Consultants and failed to compensate their workers with the minimum legally mandated wage for their time spent on tasks, instead paying them small commissions when they made sales. The lawsuit alleges that many Consultants worked many hours for Rodan & Fields’s benefit with no compensation.

2. Non-Compliance With Meal and Rest Period Regulations
California labor law mandates specific meal and rest breaks for employees. The plaintiffs claim Rodan & Fields systematically failed to provide these breaks or compensate employees with premium pay.

3. Financial Recordkeeping Failures
Accurate payroll records and wage statements are essential under California’s labor codes to maintain basic transparency and accountability.

4. Failure to Pay Wages Upon Termination
California law requires employers to issue final paychecks, including all earned wages, within specified time periods upon an employee’s separation. Plaintiffs allege that Rodan & Fields violated this law, leaving former employees without rightful compensation.

5. Unreimbursed Business Expenses
Plaintiffs allege misclassified Consultants were forced to cover their own business expenses—including samples, materials, marketing, internet and phone, and travel costs—with no reimbursement from the company. This shifted the operational burden onto the workers, sparking claims of exploitative practices.

6. Unfair Competition
By failing to adhere to labor laws and allegedly operating as a multi-level marketing scam, Plaintiffs allege Rodan & Fields LLC gained a competitive advantage over businesses that operate lawfully.
