This serves as notice to all current and former Coinbase users and/or consumers in the State of New York who maintained funds, including but not necessarily limited to cryptocurrency and/or fiat currency, in their Coinbase account, and who had funds transferred from that account without authorization at least as recently as September 24, 2020.
You might be able to assert a claim under New York General Business Law § 349 against Coinbase, Inc. for Coinbase’s alleged deceptive acts and practices in the conduct of business, trade, and commerce by, among other things, making false statements and omitting truthful information about Coinbase’s services and including unconscionable and/or unlawful provisions in its contracts, as alleged by Plaintiff Dzhura Binyaminov in the Third Amended Class Action Complaint filed on November 28, 2022 in the action Abraham Bielski, et al. v. Coinbase, Inc., Case No. 3:21-cv-07478-WHA in the Northern District of California, ECF No. 103.
Please be advised that Mr. Binyaminov dismissed his individual claims against Coinbase on May 29, 2024. As a result, the tolling of the statute of limitations for your potential New York General Business Law § 349 claim has ceased, and the statute of limitations for your potential claim has begun to run again.
Should you wish to pursue that potential claim against Coinbase, you have a limited period of time in which to do so. Please consult an attorney about your individual claims. Should you have any questions about this notice, contact Sabita Soneji at 510-254-6808.
