Consumers Seek Justice for Escrow Interest Law Preemption in Bank of America Mortgage Escrow Case

On Friday, December 8, 2023, plaintiffs, represented by Tycko & Zavareei LLP and co-counsel from other consumer advocacy firms, filed a brief with the Supreme Court of the United States asking it to overturn the Second Circuit’s decision to preempt escrow-interest laws.

In October, the U.S. Supreme Court agreed to hear the case involving Bank of America and consumers’ allegations that the bank is shirking New York and other states’ law mandating the payment of interest on mortgage escrow accounts.
