SAN FRANCISCO, CA – Several national consumer advocacy and legal aid organizations, including National Consumer Law Center, Public Justice Center, American Association for Justice, Public Counsel, East Bay Community Law Center, Public Law Center, Northwest Justice Project, Center for Economic Integrity, Legal Aid of Southern Nevada, California Low Income Consumer Coalition, Tzedek DC, and Virginia Poverty Law Center filed amici briefs during the week of November 8th in the ongoing payday lending case, Brice et al. v. Stinson et al. Consumer advocates are requesting a rehearing of the Ninth Circuit’s decision to send the case to arbitration, stating that the panel “failed to address the terms of the agreement that restrict class proceedings and limit post-arbitration review,” and that “these terms, if enforceable, mean that the borrow protections underpinning the panel’s decision do not exist.”
