July 26, 2023. In January 2023, health insurance administrative services provider NationsBenefits experienced a data breach. The cybersecurity incident potentially exposed over three million individuals’ personal information, such as names, SSNs, dates of birth, health plan subscriber information, Protected Health Information, and more. The affected individuals have filed several class action lawsuits which have been consolidated in the United States District Court for the Southern District of Florida. TZ Partner Sabita Soneji was appointed one of the Plaintiffs’ Interim Co-Lead Counsel in the matter. Along with John Yanchunis of Morgan & Morgan Complex Litigation Group and Ben Barnow of Barnow and Associates, P.C., Ms. Soneji will coordinate the work of all plaintiffs’ counsel, apprise the court as to the plaintiffs’ position, manage discovery and settlement discussions, and other pretrial activities.
The lawsuit alleges that NationsBenefits failed to properly secure its systems against cyberattacks, and that its third-party data vendor Fortra, LLC had suffered a data breach, resulting in significant exposure of consumers’ sensitive personal information and protected health information. The class action seeks compensation for those affected by the data breach and aims to protect consumer privacy going forward. This class action lawsuit is an important step towards protecting individuals’ rights and compensating them for any financial or emotional damages suffered because of the data breach.
