Tycko & Zavareei LLP Attorneys Win Partial Summary Judgment, Clearing the Way to Trial against Founders of Payday Lending Scheme

SAN FRANCISCO, CA – On July 13, 2021, U.S. District Judge William H. Orrick denied defendants’ motion for summary judgment, granted the plaintiffs’ motion for partial summary judgment, and granted plaintiffs’ motion to exclude two of the defendants’ experts in the class action case against the founders and owners of an alleged “rent-a-tribe” lending scheme.

Tycko & Zavareei LLP attorneys have been appointed Class Counsel to represent a group of consumers who were allegedly charged unlawfully high interest rates on short term loans ostensibly issued by  two Native American tribal entities: Great Plains Lending, LLC and/or Plain Green, LLC. In reality, plaintiffs allege, Defendants used these tribal entities as “fronts” to avoid state interest rate caps (usury laws).  Defendants are founders and owners who organized, financed, and/or ran the  “rent-a-tribe” lending scheme.

The cases are Kimetra Brice, et al. v. Haynes Investments, LLC., et al., Case No. 18-cv-01200-WHO and Kimetra Brice, et al. v. Mike Stinson, et al., Case No. 19-cv-01481-WHO.
