February 21, 2023. When a party files a motion to compel arbitration and the district court rules that arbitration is not required (such as if the arbitration agreement is held unlawful), does the whole case have to be stayed while the appeal is ongoing, or can the case continue forward in the trial court? This is the question before the United States Supreme Court next month regarding cryptocurrency exchange Coinbase, Inc.’s petition for writ of certiorari. The cryptocurrency platform is seeking to stay all other litigation while lower courts determine whether Coinbase customers are bound by the platform’s arbitration agreement.  Tycko & Zavareei LLP attorneys will argue this case before the Supreme Court on March 21st.
