$1.1 Million Qui Tam Customs Fraud Case Against Battery Manufacturer

Outcome: $1,107,761 settlement and 20% whistleblower reward

Jonathan Tycko, a partner at Tycko & Zavareei LLP, advocated for a whistleblower in a False Claims Act qui tam case against Eos Energy Storage, LLC. Eos Energy, a subsidiary of Eos Energy Enterprises, Inc., was accused of engaging in customs fraud by falsifying the value of “dry batteries” manufactured in China and imported into the United States. The lawsuit further revealed that Eos Energy had underpaid duties on these imported batteries. As a result, the government reached a settlement amounting to $1,107,761 with Eos Energy, and the whistleblower received a well-deserved 20% share as a reward.
