$16 Million Settlement in Capital One Representment Fees Class Action

McNeil v. Capital One Bank, Case No.: 1:19-cv-00473-DG-TAM in the United States District Court for the Eastern District of New York

A $16 million class action settlement has been reached for Capital One accountholders who were allegedly charged unfair representment fees between September 1, 2015, and January 12, 2022. The lawsuit, filed in the United States District Court for the Eastern District of New York, claimed that Capital One breached contracts and violated consumer protection laws by charging multiple Non-Sufficient Funds (NSF) or Overdraft Fees on the same item when it was resubmitted to the bank.

The settlement concludes over two and a half years of litigation, in which Tycko & Zavareei LLP was one of the firms appointed Class Counsel. Affected Capital One accountholders are eligible for compensation from the settlement fund, which aims to provide relief for those wrongfully charged multiple fees on the same transaction.
