Outcome: $38 Million Settlement

After a lengthy four-year legal battle, final approval was granted for a $38 million class action settlement to reimburse purchasers of Lash Boost, an eye makeup product containing Isopropyl Cloprostenate. The settlement also provided beneficial injunctive relief in the form of additional disclosures that will alert consumers about potential risks associated with this ingredient going forward.
“I want to commend the parties and counsel for something that is perhaps more complicated and larger than the typical kind of class action settlement that we typically see tendered for approval, at least in State Court, and one to which it’s obvious that very careful attention has been paid and that will result in a real benefit to claimants, and I want to commend you on that,” remarked Judge Ethan P. Schulman. Additionally, named plaintiffs received $15,000 incentive awards.
